Article 26

26.01 A

This Article contains provisions exclusively related to partial-load employees. However, this Article is not inclusive of all rights of partial-load employees under the Collective Agreement.

26.01 B

A partial-load employee is defined as a teacher who teaches more than six and up to and including 12 hours per week on a regular basis.


26.02 A

A partial-load employee shall not receive salary or vacations but shall be paid for the performance of each teaching contact hour at an hourly rate calculated in accordance with 26.04.

26.02 B

A portion of the hourly rate for partial-load teachers is in lieu of vacation pay.

26.02 C

Entitlement to any vacation time will be provided in accordance with the Employment Standards Act, 2000.


26.03 A

Determination of partial-load teachers’ starting step and progression within the hourly rate schedules shall be in accordance with the Job Classification Plans (see pages 129-135).

26.03 B

The College shall endeavour to issue all contracts prior to the start of the contract.  The College shall, upon the initial hiring of a partial-load teacher in the bargaining unit, forward a copy of the initial step placement calculation to the Union Local President.

26.03

Partial-load employees will be provided a copy of the Collective Agreement on the first occasion they are employed following the negotiation of a new Collective Agreement or if re-employment occurs more than one year after the end of the previous partial-load contract.


26.04

The following tables indicate the hourly rate paid at each step for partial-load employees. For progression on the grid, refer to 26.10 B.

26.05

A partial-load employee shall pay dues in accordance with Article 10, Union Deduction.


26.06 Insured Group Benefits

26.06 A Extended Health, Vision and Hearing Care

The College shall pay 100% of the billed premium of the Extended Health Plan found in Article 19, Other Insurance Plans, for partial-load employees, excluding Vision and Hearing coverage, and subject to the application procedures for this benefit, with the exception of those employees who opt out of the plan because of spousal coverage elsewhere.

The College shall provide for access to the Dental, Vision Care, Hearing Care, Critical Illness/Catastrophic Event Insurance and Life Insurance Plans found in Article 19, Other Insurance Plans, for partial-load employees provided the premium is paid by the employee.

26.6 D Group Insurance – Bridging Benefit

If upon termination of a contract there is a written contract for future employment as a partial-load employee; or a commitment in writing by the College and the partial-load employee to future partial-load employment, not more than 5 months after the termination of the contract, which will be confirmed in a future contract,

the employee, by paying 100% of the premiums for the benefits, may continue participation throughout the period between contracts in any group insurance plan in which that employee was participating.

Where the College is anticipating re-employment of a partial-load employee, the College is encouraged, where feasible, to provide a written contract upon termination.

Any written contract or written offer from the College of future partial-load employment is conditional on the College subsequently determining there is sufficient enrolment to warrant the assignment being offered.

If an employee is re-employed within 6 months of the end of any contract, waiting periods for group insurance plans will be waived.


26.07 Tuition Subsidy and Leaves of Absence

The College shall provide partial-load employees with access to the rights provided in Article 12, Tuition Subsidy; Article 21, Leaves of Absence; Article 22, Pregnancy and Parental Leave, and Article 23, Prepaid Leave Plan, of this Agreement. Details regarding participation, eligibility, waiting period and benefit level are as follows:

26.08 Short-Term Disability Plan

26.08 A

Partial-load employees will be covered by the Short-Term Disability Plan described in Article 17 of this Agreement with the 20 working days of coverage for 100% regular pay to be pro-rated in accordance with the table found in 26.08 B. Details regarding participation, eligibility, waiting period and benefit level are as follows:

26.08 C Sick Leave Plan – Bridging Benefit

Partial-load employees hired up to and including March 31, 1991 who were re-hired within 6 months of the end of any contract, or who were re-hired within 6 months of the end of any approved leave of absence or where upon termination there was a written contract for future employment as a partial-load employee shall be covered by the cumulative sick leave plan which was in place for the full-time academic employees hired up to and including March 31, 1991.

Partial-load employees hired on or after April 1, 1991 are covered by the short- term disability plan described in Article 17 as modified by Articles 26.08 A and 26.08 B but will also enjoy the bridging provisions as set out above.


26.09 Statutory and College Holidays

Partial-load employees who are under contract on the last working day prior and the working day subsequent to a holiday as defined in Article 16, Holidays, shall be paid for these if they are regularly scheduled teaching days. Under contract means there is a written contract between the College and the employee. Details regarding participation, eligibility, waiting period and benefit level are as follows:

26.10 Job Security

26.10 A

It is agreed that Article 27, Job Security, has no application to partial-load teachers except as referred to in 27.04 A, 27.06 A (iv), (v), (vi), 27.08 B, 27.11 B and 27.12. Such partial-load teachers may be released upon 30 days’ written notice and shall resign by giving 30 days’ written notice.

26.10 B

For the purpose of determining the service of a partial-load teacher under 27.06 A (iv), (v), (vi), and 27.08 B and for the purpose of determining progression through the grid ten months of on-the-job experience will entitle the employee to one year of service and to progress one step on the grid, except as noted in 26.10 C.

26.10 C

On-the-job experience will be calculated as follows: a partial-load teacher will be entitled to credit for service from September 1, 1971 (but not earlier) on the basis of ½ month’s credit for each full month of service up to January 1, 1977 and thereafter on the basis of ½ month’s credit for each calendar month in which the employee teaches 30 hours or more and from October 1, 2017 (but not earlier) on the basis of one month credit for each calendar month in which the employee teaches 30 hours or more up to the day before the release of the 2022 Kaplan Award, and from the date of release of the 2022 Kaplan Award (but not earlier) on the basis of one month credit for each calendar month in which the professor or instructor is teaching 28 hours or more.

26.10 D

In addition to maintaining a record of a partial-load employee’s job experience, the college shall keep a record of the courses that the employee has taught on or after December 20, 2017, in a part-time, partial-load or sessional capacity and the departments/schools where the partial-load employee has taught such courses. An employee may provide the college with evidence of courses that the employee has taught in a part-time, partial-load, or sessional capacity prior to December 20, 2017.

By April 30th in each year, a currently or previously employed partial-load employee must register their interest in being employed as a partial-load employee in the following academic year and the maximum number of teaching contact hours that
they are prepared to teach (to a maximum of 12). This individual will be considered a registered partial-load employee for the purpose of 26.10 E. For the Fall, Winter, Spring and Summer terms of the 2021-2022 academic year and the Fall 2022semester, partial-load employees must register no later than October 30, 2021.

Upon request, the College will make available to the Union, 4 weeks after April 30th in each year, a list of the partial-load employees who have registered in accordance with this article and the courses which the partial-load employee has taught on or
after December 20, 2017, in a part-time, partial-load or sessional capacity.

26.10 E

Subject to the application of Articles 2.02 and 27.06, commencing in the 2018-2019 academic year, where the school or department within a college determines that there is a need to hire a partial-load employee to teach a course that has previously
been taught by that registered partial-load employee, pursuant to 26.10 D in the department/school, it shall give priority in hiring to such partial-load employee if:


(i) They are currently employed, or if they have previously been employed as a partial-load employee for at least eight (8) months of service as defined in 26.10 C within the last four (4) academic years, and


(ii) The assignment of such course will not cause the employee to exceed the maximum teaching contact hours for partial-load employees. Where a school or department determines that there is a need to assign a course on a partial-load basis and a partial-load employee has priority over such course, the school or department shall offer such employee the maximum number of teaching contact hours from amongst the courses for which they have priority but not exceeding the number of teaching contact hours that the partial load employee has indicated their preparedness to teach. Where the assignment of one or more courses is cancelled the school or department shall not be required to reassign or redistribute courses.

The offer of partial-load employment is conditional on the college subsequently determining there is sufficient enrolment to warrant the assignment being offered. Where two (2) or more partial-load employees would be entitled to be offered the
course assignment, the employee with the most service will be offered the first opportunity.

The College shall not circumvent the priority established pursuant to this article by assigning a new course code or name to a course unless there has been a major revision of the course or curriculum.

26.10 F

Where a partial-load employee advises the College that the employee has:

(i) given birth to a child and has not worked for a period of up to 78 weeks from the date of birth; or

(ii) has become a parent, not by giving birth, and has not worked for a period of up to 63 weeks from the date that the child has come into the custody, care and control of the employee for the first time;

The College will extend the period in 26.10 E (i) by such period that the employee has not worked.

26.10 G

It is understood that a partial-load employee’s priority in hiring provided for in article 26.10 E shall cease to apply where the partial load employee is terminated from employment for cause, which termination is not reversed pursuant to the grievance and arbitration procedure in article 32.

Partial Load Benefits Explained

Benefits Eligibility:

If you are eligible for Sun Life benefits as a result of having a partial-load contract (7-12 teaching hours per week), you should have completed paperwork at onboarding or when you became eligible.

You may have been on a part-time contract (6 teaching hours or less per week) when first hired (and therefore not eligible for Sun Life benefits), and at a later point have been offered a partial-load contract (therefore becoming eligible for Sun Life benefits).

In either case, benefits are terminated by the college at the end of the partial-load contract and usually expire at the end of the calendar month of your expired contract.

Bridging Benefits:

Benefits coverage will stop at the end of the month that your contract ends. If you are re-employed as a partial load employee within six months of the end of your contract, the waiting period for the group benefits you are participating in will be waived and your benefits reinstated on the date of your contract.

If you are re-employed after six months, you will be considered a new employee and will be required to complete the waiting period to receive benefit coverage.

When a contract ends in April or June, group benefits can be bridged and the cost of benefits are paid by the individual faculty member. Bridging benefits has an upfront cost.

In between the Fall and Winter semesters, group benefits will be reinstated effective the first day of your new contract, and there is usually a lag of 24-48 hours for the Sun Life system. It is always wise to wait 48 hours for the Sun Life update before submitting any claims.

Member Services and Coverage Details

To access Sun Life’s Plan Member Services, you will need an access ID and password. Please follow the instructions as provided on Sun Life’s website.

As you may be aware, you can stop your optional coverage or change to single coverage at any time, but you can only change from single to family or add optional coverage if (1) there is a break in your partial-load contracts of more than six months or (2) for life insurance only, you complete the prescribed health questionnaire or there is a change in your dependents or marital status. If there is a change in your dependents or marital status you may choose family and/or optional coverage by completing a new enrolment form and submitting it within 31 days of the change.

Online Benefit Claims are available.  Active employees have the option to submit paramedical, vision care and dental claims electronically through Sun Life’s plan member site.

Please be advised that while the information pertaining to the claim is submitted electronically, you will need to keep your original receipts for a period of 12 months from the date of claim in case Sun Life conducts an audit. Failure to provide receipts when requested by Sun Life will result in the loss of access to online claims, and possible further action. This service is not mandatory, so you can still submit paper claims.

Maternity and PD Leave

Partial-load contract faculty maternity leave tops salary up to 92% of pay on whatever remains of your contract, which is normally a max of 4 months.

Although paid professional development (PD) leave opportunities are available to full-time faculty—including, in some cases, funding towards further post secondary studies—faculty on partial-load contracts do not have access to paid PD leave.

Your supervisor may offer some compensation, at their discretion, for workshops/conferences; however, most do not.  Please check with your supervisor.

Contract offers

You should receive an email from your supervisor offering you a teaching assignment in writing. Once you discuss/accept the emailed offer of teaching, you will receive a follow-up email from HR with Cornerstone log-in directions.

Email presence during non-contract time:

You are not obligated to monitor or respond to email messages from the College during non-paid time.

If your supervisor emails offers of teaching to your DC mail account, you can supply them with an alternative email to which they can send any teaching assignment offers.

Faculty Members who work at multiple colleges

While working at 2 colleges you will continue to contribute to your pension at both colleges as long as you signed up for your pension at both. CAAT will be advised that you work at 2 colleges.

If you have a partial-load contract at multiple colleges, only one college can offer you full benefits. The other college would have to provide you with just basic medical benefits.
